Amicus letter Curacao

Amicus letter Curacao

On Curaçao, due to lack of money, hundreds of families have been disconnected from water, or never even connected to the water network. Human rights organizations in Curaçao are therefore concerned about Curaçao households that are currently disconnected. The Ombudsman of Curaçao, together with the Ombudsman of Sint Maarten and the National Ombudsman, have already pointed out the lack of access to clean drinking water for vulnerable citizens in Curaçao in 2020.

Association Hende-i-Medio-Ambiente (HiMA) initiated proceedings against the Country of Curaçao regarding the right of access to clean water and adequate sanitation for a group of vulnerable people, including the elderly and minor children. HiMA approached PILP because of the proceedings in the Netherlands that Defense for Children and NJCM are conducting on the right to water for children. The same arguments are at play in both proceedings and the Country of Curaçao relies on the first instance ruling of the District Court of The Hague. Defence for Children Netherlands and the NJCM have appealed that ruling.

On behalf of and with Defence for Children Netherlands and the NJCM, as amicus curiae, PILP wrote an amicus brief to the Court of First Instance in Curaçao on February 21, 2023. In the letter, the organizations address what the right to water for children includes and why they should not be cut off from it. In this way, PILP, NJCM and Defense for Children Netherlands hope to contribute to the protection of children’s rights in the Kingdom of the Netherlands. They strongly hope that the Court of First Instance will consider this amicus brief and that the brief will contribute to the present proceedings. The judgment in Curacao is expected in mid-January 2024.

Historic ruling: Dutch state and drinking water companies must stop cutting off drinking water to families with children

The Dutch government’s policy of disconnecting children from drinking water in the event of non-payment is unlawful. The Dutch State and drinking water companies PWN and Dunea deliberately left open the possibility that children, through no fault of their own, find themselves in a situation with far too little access to drinking water. This is […]
