Strategic litigation
Strategic litigation, according to PILP, involves the deliberate use of legal resources, including litigation, proceedings and legal advice. This is not only about the strategic use of law versus other means such as media, lobbying and protest, but also about making strategic choices within legal proceedings themselves.
Philosophy: Movement Lawyering
PILP emphasizes that law should only be used as a tool if it can strengthen the campaigns and goals of the parties involved. For PILP, litigation is not an end in itself. PILP’s approach, also known as Movement Lawyering, places communities, movements and activists at the center of the legal battle being waged for and with them.
Legal integrity and advice
PILP recognizes, however, that all litigation conducted must be legally meaningful and procedurally correct. After all, this is ultimately in the best interests of clients as well. PILP will advise against initiating legal action if it is not strategic. The law firm operates fully within the applicable (conduct) rules and laws for the legal profession.
