Facebook and EU Privacy law

Letter addressed to Facebook Inc.

PILP, together with Stichting Privacy First, Bits of Freedom and the Platform for the Protection of Civil Rights and two citizens, has sent a letter to Facebook in which we demand to stop the data transfer to the United States. This is partly in response to the ruling by the European Court of Justice in the case Schrems v. Data Protection Commissioner. In this case, the Court of Justice found that the so-called safe harbor principles are not in line with EU law. As a result, Facebook’s policy, which relied on these principles, does not appear to be either.
Lawyers in the case are Boekx’s lawyers.

The letter already received a fair amount of media attention.

After failing to receive an official response, another letter was sent to Facebook, about which Boekx also wrote a press release.

Facebook responded on December 15, 2015. Facebook claimed when transferring personal data to the U.S., it was operating in a perfectly legal manner. Facebook claims to operate the same way as any other company that transfers personal data to the US.

Because there has been much media attention and criticism surrounding this issue and because a case had also been filed in Ireland, we have not taken any further steps to date. We do continue to monitor developments.
