Unfortunately, the Court of Appeal has affirmed the verdict of the court of first instance. Furthermore, the Court of Appeal decided not to ask prejudicial questions to the EU Court of Justice.
The Court of Appeal did however see the fundamental character of the case and extensively took into consideration the points of critique and human rights objections that we posed, but in the end the Court of Appeal did not rule in favour of us.
